Agreement of Terms

By accessing and using the Greater Fort Myers Chamber of Commerce website (“Website”), mobile applications, and related services (collectively, “Services”), you agree to be bound by these Terms of Use (“Terms”). Eligibility and Registration

Member Benefits

Member benefits are subject to availability and may change without notice. The Chamber reserves the right to modify or discontinue member benefits at any time.

Acceptable Use Policy

You may use our Services for legitimate business and professional purposes consistent with the Chamber’s mission and these Terms.

Prohibited Uses

Events and Programs

Event Registration

Event registration is subject to availability and payment of applicable fees. Registration fees are non-refundable unless otherwise specified in the event terms.

Event Conduct

Attendees at Chamber events must:

  • Conduct themselves professionally and respectfully
  • Comply with venue rules and regulations
  • Follow all applicable safety guidelines
  • Respect the intellectual property rights of speakers and presenters

Event Modifications

The Chamber reserves the right to modify, reschedule, or cancel events. In case of cancellation, we will provide appropriate notice and refunds when applicable.

photography and Recoring

By attending Chamber events, you consent to being photographed, recorded, or filmed for promotional and marketing purposes.

Job Board and Employment Services

Employers using our job board services must:

  • Provide accurate and complete job descriptions
  • Comply with all applicable employment laws
  • Not post discriminatory or misleading job advertisements
  • Respond to inquiries in a timely and professional manner

Employment Disclaimer

The Chamber does not guarantee the accuracy of job postings or the suitability of candidates. We are not responsible for employment decisions or disputes between employers and job seekers.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you also agree to our Privacy Policy.

Disclaimers and Limitations

Service Availability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE CHAMBER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE CHAMBER IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless the Chamber, its directors, officers, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content or other submissions

Termination

Termination by You

You may terminate your account and stop using our Services at any time by contacting us or following the account closure procedures.

Termination by the Chamber

We may suspend or terminate your access to our Services at any time, with or without cause, including for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Conduct that harms the Chamber or its members

Effect of Termination

Upon termination:

  • Your right to use our Services immediately ceases
  • We may delete your account and associated data
  • Provisions that should survive termination will remain in effect

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Jurisdiction

The Chamber shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical failures.

Notices under these Terms may be delivered electronically to the email address associated with your account or by mail to your registered address.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:
